WNPB Gym (Adrenaline Boxing Club) Terms of Use

Please read these Terms of Use carefully. This document explains your rights and obligations regarding your use of WNPB Gym, LLC’s Activities, as defined below.

1. Eligibility and Acceptance of Terms of Use

• Eligibility: You must be over 18 years old to accept these Terms of Use. If you are under 18, a parent or legal guardian must accept these terms on your behalf. By accepting, you represent that you are an adult accepting this agreement for yourself and/or on behalf of your minor child(ren) who will participate in the Activities.
• Acceptance of Terms: By accessing or using the Services or any related products, or by engaging in any Activities, you agree to comply with these Terms of Use. If you do not agree, you may not access or use the Services or participate in the Activities.

2. California Residents: Waiver of Rights Under Section 1542

• California Civil Code Section 1542 Waiver: By signing this Agreement, you agree to waive all claims against the Releasees, known or unknown, per California Civil Code Section 1542, which states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

3. Communications

• By providing your telephone number, you authorize Adrenaline Boxing Club to contact you by call or text, including automated systems or prerecorded messages, for notifications related to your Activities, such as cancellations, billing updates, and waitlist changes. Conversations or communications may be monitored or recorded for quality purposes.

4. No Assignment

• These Terms of Use are not assignable, transferable, or sublicensable by you without prior written consent from an authorized Adrenaline Boxing Club representative.

5. Membership Term

• Membership Duration and Renewal: Membership begins on the date this Agreement is signed and will renew monthly unless canceled as outlined herein. Monthly fees are due regardless of Member attendance. Payments will be automatically debited each month from the card or bank account on file.

6. Billing and Payment Terms

• Automatic Payment Authorization: By signing this Agreement, you authorize the Gym to automatically debit the monthly membership fee from the provided payment method. Failure to provide an updated payment method may result in membership suspension.

7. Cancellation Policy

• 3-Day Right to Cancel: You may cancel this Agreement within three business days from the signing date without penalty, with a full refund of any fees paid.
• Ongoing Membership Cancellation: After the initial 3-day period, you may cancel by providing 30 days’ written notice. Cancellation will be effective at the end of the next billing cycle following the 30-day notice.
• Cancellation Fees: No additional fees apply beyond the requirement of 30 days' notice.

8. Refund Policy

• Membership fees are non-refundable except in cases of valid cancellation within the initial 3-day period or documented medical issues.

9. Gym Rules and Code of Conduct

• Members must adhere to all posted rules and staff instructions. The Gym reserves the right to suspend or terminate membership for non-compliance with conduct standards or gym policies.

10. Photo/Video Release Acknowledgement

• By signing, I grant permission to Adrenaline Boxing Club to use my likeness in photographs and/or videos taken during my participation in club activities and group or personal classes. I understand that these images may be used for promotional purposes, including but not limited to, social media, marketing materials, and the club's website. You may opt out by providing written or verbal notice to the Gym.

11. Modification of Terms

• The Gym reserves the right to modify this Agreement, including membership fees, with at least 30 days’ notice to Members. Continued use of the Gym after any modification indicates acceptance of the revised terms.

12. Severability

• If any provision in these Terms is held by a court to be unlawful, that provision will be amended to best reflect the original intent and the remainder of the Terms will stay in effect.

13. Governing Law

• These Terms of Use will be governed and interpreted according to California state laws without consideration of conflict-of-law principles.

I am signing this willingly after having read the Fitness Waiver and fully understanding the terms and conditions set forth above.
